Terms of use

Your consent

This is an agreement between Universal Sounds GmbH (business name: Universal App), with its registered office in Oltingen (Switzerland) and owner and operator of the website https://universalapp.ch and you (user of the service).

By using this service, you acknowledge and agree to these Terms of Use and the Privacy Policy.

Changes

We may occasionally make changes to the App or these Terms. If we do, we’ll notify you either by updating the Effective Date of these Terms listed above and via the App. You must accept these changes in order to continue using the App. You should stop using the App if you disagree with any changes to the App or these Terms.

From time to time we may issue updates to the App via the App Store. Depending on the update, you may not be able to use the App until you have downloaded the latest version of the App and reviewed and accepted any new terms.

Accessing the App and the content on the App

You may access the App by downloading and installing the App to your device from the App Store. Although we are working to ensure that the App is compatible across various devices, we cannot guarantee that the App will work with all devices. You should check the minimum requirements and specifications (including memory space and operating system) as set out in the App details on the applicable App Store before downloading the App. We will endeavour to support the two most recent versions of the operating systems available in the market – for example, if iOS 11 is the current version, we will aim to support iOS 10 and iOS 11). To download the App, you will need a valid App Store account (as applicable to your device).

It is your responsibility to ensure that you are able to comply with the relevant system requirements as described above. We accept no responsibility for any lack of functionality that is due to your equipment (including your device, internet connection, operating system or settings and software). Access to parts or all of the App and any or all content on the App may be restricted from time to time to allow for repairs, maintenance or updating.

It is your responsibility to pay for all costs and expenses (including all telephone call or line charges or Internet service data access) that you may incur using the App.

Your use of the App and enjoyment of its features and content hosted or made available through the App may vary in functionality, availability and quality depending on the type of device and operating system and any restrictions imposed by our content providers.

Subscription Cancellation, Refunds & Availability

You will be required to select your type of Subscription. Please ensure that you select the appropriate Subscription when prompted.

In most cases, your subscription will renew automatically within 24 hours prior to the end of the current period unless cancelled. You can switch off the automatic renewal via the store you purchased from before your next subscription payment is due. To manage your subscription, please go to your store account settings.

You may cancel your subscription at any time. Cancellations should be made via the store that you purchased your subscription from. If you need assistance, please email support@universalapp.ch

In general, cancellations take effect at the end of your then-current subscription term (for example, if you are on a paid monthly subscription the cancellation will take effect the following month, but if you are on a paid yearly subscription the cancellation will take effect the following year).

In the event that we cease to provide the App, all subscriptions will be terminated. No refunds will be due.

In certain limited circumstances We may cancel your Subscription and/or close your Account. If we take such action, you will be notified by email and We will provide an explanation for the cancellation and/or closure. (a) if your Account is closed and your Subscription cancelled because you have breached these Terms and Conditions, you will not be entitled to a refund. If you believe We have closed your Account and cancelled your Subscription in error, please contact Us at support@Puniversalapp.ch (b) if your Account is closed and/or your Subscription is cancelled for any other reason, you will be refunded the remaining balance of your Subscription for that month only. The refund will be calculated based upon the price of your Subscription being divided by the total number of days in the Subscription and multiplied by the number of whole days remaining until the end of the Subscription (or, in the case of auto-renewing Subscriptions, until the renewal date). Any and all refunds due to you will be made no later than 14 calendar days after the date on which the closure and/or cancellation becomes effective. Refunds will be made to your original payment method.

We make all reasonable efforts to ensure that all general descriptions of the Services available from Us correspond to the actual services that we provide to you. There may, however, be

Subscription options available for CHF 5.00, 8.00 or 13.00* per month on a recurring basis or CHF 55.00, 89.00 or 145.00* per year.

You can decide for yourself what the Universal App is worth to you. With your monthly or annual contribution, you get with all subscription the same access to all content: Radio’s incl. Podcasts – Event Calendar – Radio Chat

The personal chat and social media will be added in the next versions; the subscription price will remain the same.

You can cancel your subscription at any time. Without a subscription, access to all content is blocked. Thank you for your financial contribution.

Subscription fees are non-refundable.

Please note that Apple App Store, Google Play and Online/Stripe do not send reminders to cancel if you do not wish to become a paid subscriber.

*Prices quoted are in CHF for purchases via the web. Price will vary depending on buyer’s purchasing store, country and currency of transaction.

Permitted content and appropriate use

At Universal Sounds, we’re all about a positive and mindful user experience. We focus on making Universal App practical and beneficial for you and your communities. The following guidelines should contribute to this.

Prohibited:

  • Sending unsolicited or unauthorised advertising or business communications such as spam.
  • Performing spidering, data harvesting or use of software or spyware that collects data from the Site or Services.
  • Use of automated methods to use the website or services.
  • Stalk, harass, bully, intimidate or hurt other users.
  • Publication of illegal, offensive, obscene or pornographic content.
  • Pretending to be someone else.
  • Publication of content that is offensive, threatening, hurtful, incites violence or contains graphic or gratuitous depictions of violence.
  • Use of Universal App for unlawful, false, malicious or discriminatory acts.
  • Publishing content that you do not have the right to publish.
  • Publication of content that infringes trademarks or copyrights.
  • Publishing viruses or malicious scripts.
  • Publishing spam or link baits.
  • Attempts to circumvent technical security measures designed to protect the site or services of Universal App or third party companies (including other users).
  • Attempts to decrypt, decompile or disassemble or reverse engineer the software to protect the Site or Services.
  • Soliciting, encouraging and assisting a third party to commit one of these listed acts.

All rights reserved

Universal App may, at its sole discretion, close accounts if their users violate the Terms of Service. Universal App reserves the right to view private groups ONLY to troubleshoot and resolve complaints regarding the Terms of Service or upon legal request. Universal App reserves the right to view any private and public group to ensure compliance with the Terms of Service. Universal App reserves the right to remove any content that violates our Terms of Use without notice.

Universal App reserves the right to block groups and users who, in Universal App’s sole discretion and interpretation of the Terms of Service, do not comply with them. In such a case, users do not need to be informed. Blocked users may contact Universal App customer service for further information. Please abide by the Terms of Use.

Although we have the right to monitor activity and content on Universal App, we are under no obligation to do so. We do not guarantee the accuracy, integrity or quality of content posted by users. Because standards may vary and some individuals may sometimes fail to comply with our policies and procedures, you may see content in your community on Universal App that is offensive or objectionable. We do not endorse, support or guarantee the comprehensiveness, truthfulness, accuracy or reliability of any content or posts published on Univeral App and do not expressly endorse any opinions published on Univerasal App. We investigate complaints and policy violations we hear about and take the necessary steps, such as issuing warnings, removing content, or deleting accounts or subscriptions. In addition, however, we reserve the right to take no action. We are not responsible in any way for any Content that contains errors or omissions, or for any damage or loss of any kind incurred as a result of using or being prohibited from using the Content on the Website.

Due to storage limitations and expenses, Universal App reserves the right to close user accounts whose users have not logged in for more than 12 months. Universal App will notify those users whose accounts are to be closed by email or SMS after 11 months of inactivity and allow them 30 days to reactivate the account and content on Universal App or download the content to their computer. Universal App sends a final notice 48 hours before deleting the account.

Target group of our services

The use of Universal App is open to all persons who accept these Terms of Use.

Data protection

Your personal privacy and the protection of your personal data is of great importance to us. You are responsible for maintaining the confidentiality of your Universal App account information, including your username and password. You are responsible for all activities that occur with your Universal App account and immediately notify Universal App of any unauthorised access or use of your Universal App account. Universal App is not responsible or liable for any damage or loss caused by unauthorised access or use of your Universal App account. Ownership of the user content

Materials published by Universal App users, such as text, data, images, graphics, photos, audio, audiovisual, video and other content (“User Contributions”) belong to the person publishing them. As a Universal App user, you are solely responsible for your Submissions. By submitting your Submissions or otherwise using Universal App, you acknowledge that you have all rights and permissions to publish, transmit, produce or otherwise use such content. You agree that you will not submit any material that is the intellectual property of a third party for which you have not obtained permission to post. You acknowledge that your User Content does not infringe any intellectual property rights, privacy rights, publicity rights or other rights of any third party.

Universal App is not responsible for the accuracy, usefulness, safety or intellectual property rights of any User Submission that is inaccurate, infringes a copyright, is offensive, indecent or objectionable. You agree that all content posted via Universal App or on Universal App is the sole responsibility of the person who created that content and we are in no way responsible for any errors or omissions in the content. You agree that we cannot confirm the identity of any user or the accuracy of any information posted by any user on the Universal App.

Passwords

You are responsible for the security of your Universal App password and for any activity or operations conducted under your password. We advise you to use strong passwords for your account; i.e., passwords that consist of a combination of upper and lower case letters, numbers and symbols. Universal App will not be liable for any loss or damage caused by failure to comply with the above.

Our commitment to data security

Universal App uses commercially reasonable physical, operational and technical safeguards to protect the integrity and security of your personal information. However, we cannot completely guarantee the security of the information you provide to Universal App. Consequently, you do so at your own risk. After we receive your information, Universal App uses commercially reasonable safeguards to ensure the security of our systems. However, this does not guarantee that such information will not be accessed, disclosed, altered or destroyed in violation of our physical, technical or managerial safeguards. If Universal App becomes aware of a breach of security, we will contact you electronically so that you can take appropriate security measures. If our safeguards are breached, Universal App may post a notice on the Universal App website or Universal App service.

Universal App Log Data

When you use our Service, we may receive information (“Log Data”) such as your IP address, browser type, operating system, referring websites, websites visited, location, your mobile carrier, and information about your device (including device and app ID). We receive this log information when you use our Service; for example, when you visit our websites, log in to us, follow our email notifications or use your account to authenticate to a third party website or app. We may also receive Log Data when you click, view or respond to a link on our Service. Universal App uses the Log Data to provide, understand and improve our Service. The log data, or any general data about your account such as your username, full IP address or email address, will be deleted after a maximum of 12 months.

Universal App Secret Chat

Universal App cannot decrypt the messages sent via the Secret Chats as they are protected by end-to-end encryption and Universal App does not have access to these private keys. The encrypted messages and media (photos, videos, etc.) sent via the Secret Chat will be deleted from the Universal App servers after their successful transmission.

Universal App Invitations and “Add Automatically

You may find it easier to find and connect with your friends with the Auto Add feature. When you select “Add Automatically”, Universal App collects phone numbers and email addresses from your address books and helps you connect with those friends on Universal App who have agreed to use their phone number or email address (“Add Automatically”). The “Add Automatically” feature allows you to:

  1. Notify you when a contact becomes active on Universal App.
  2. Show you which of your contacts are already Universal App members.

You can also use the Universal App invitation service. When you use this service, Universal App accesses your address book with your permission. From the desktop, you can upload your address book to your Universal App account. You must give Universal App permission to do this. You can also invite individual friends and contacts to connect with you on Universal App. You can do this by using your personal Universal App link or by sending them an SMS or email via the Universal App invitation service. If you give Universal App permission to upload your address book to send invitations, Universal App may store a copy of the phone numbers, email addresses and names in your address book on the Universal App servers. This information is only used for the Universal App invitation service and the “Add Automatically” feature.

Any information from the address books that you upload or sync is subject to these Terms of Use and Universal App Privacy Policy. You can delete your address book at any time and turn off the “Add Automatically” feature at any time via “Contacts” -> “Settings”. If you choose to delete your address book or turn off the “Add Automatically” feature, your address book will be immediately deleted from our main server. The deletion from our backup servers takes place in the next processing cycle, which is carried out approx. every 6 months.

Ownership of the Website and Services

Unlike the User Content (for which we do not claim copyright), we own all rights and interests in the Site and the Service, including all software, text, media and other content available on the Site and through the Service and the Universal App Logo.

Further provisions

Under no circumstances will Universal App be liable for delays or failure to perform arising from natural circumstances or force majeure.

If any provision of these terms and conditions shall be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity of any remaining provisions.

Universal App’s failure to enforce any right or provision of these Terms of Use does not mean that Universal App will not enforce it in the future.

Universal App reserves the right, at its sole discretion, to change these Terms. The new Terms will apply from the date of publication of the new version on the Website and you, as a User, will be notified thereof. Your continued use of the Service constitutes your acceptance of the Terms and any changes, revisions and postings to the Website. We may assign our rights and obligations under these Terms.

You accept that disputes relating to these Terms of Use, the Site or the Service shall be subject only to the jurisdiction of the courts at the location of the registered office of the Company.
